Tewksbury Couple Arrested For Running Illegal Medical Marijuana Business

A Tewksbury couple has been arrested for operating an illegal medical marijuana operation out of their home and advertising the business on Facebook.

Mark Harrington, 28, and Holly Harrington, 28, both of 54 Patten Road, were arrested on Tuesday on several drug charges.  

According to Tewksbury Police, detectives were tipped off to the fact that the Harringtons claimed to be running a legal medical marijuana business called HTM Gardening, LLC, out of their home. A Facebook page listed Mark Harrington as president and CEO of the company.

"The suspects posted numerous photos on Facebook of plants they were growing and money that they were receiving, claiming to be running a legitimate business with a variety of marijuana types for different ailments," a TPD press release read, in part.

On the HTM Gardening Facebook page, the Harringtons described their business this way:

“We provide delivery of medicinal marijuana to certified patients in Massachusetts. We have a great selection of different strains to fit your medical needs.  We also offer edibles for consumption including but not limited to hard candies, chocolates, caramels, cupcakes, brownies, rice krispie treats, white chocolate covered oreos and chocolate chip cookies. We also carry CBD drops, THC oil for vape pens and candy with Tincture. We also offer vaporizers and atomizers to our clients.  We also carry Blonde Afghan Hash and Bubble Hash.  We are open seven days a week and becoming a patient is easy, simply fill out the New Patient Application below and email a copy of your certification, a photo I.D. and a signed Health Care Release Form so we can call to verify your certificate is valid.”

According to Tewksbury Police Chief Timothy Sheehan, detectives consulted with other law enforcement agencies and with the Department of Public Health regarding the new laws on medical marijuana in Massachusetts. According to Sheehan, detectives confirmed that a person who has been given “caregiver status” can only grow marijuana for one person who has a medical marijuana card and cannot offer the drug for sale. In addition, the marijuana plants that are being grown cannot be visible or accessible to the public.

Based on that information, detectives launched an undercover operation. An undercover Detective called the number that was listed on Facebook for HTM Gardening, LLC and requested an amount of marijuana. Mark and Holly Harrington met with the detective and sold him marijuana.  

Detectives were also able to observe several marijuana plants in the back yard of 54 Patten Road in plain view. Detectives then requested and executed a search warrant on the property. A large amount of marijuana and prescription pills were recovered, along with several edible marijuana products.      

Mark Harrington was charged with the following;

  • Conspiracy to violate drug law 
  • Drug, Possess to Distribute Class D (Marijuana)
  • Unlawful manufacture, cultivation, distribution of (Marijuana)
  • Drug, Possess to Distribute Class C Subsq. Off. (Promethazine)
  • Drug, Possess to Distribute Class C Subsq. Off. (Diazepam)
  • Drug, Possess to Distribute Class E Subsq. Off.(Clonazepam)
  • Drug, Possess Class A (#7 Codeine)
  • Drug, Possess Class B (#4 Suboxone)
  • Drug, Possess Class B (#9 Methadone)
  • Drug, Possess Class C (#6 Alprazolam)
  • Drug, Possess Class E (#5 Clonidine)
  • Drug, Possess Class E (#2 Quetiapine)

Holly Harrington was charged with the following;

  • Drug, Possess to Distribute Class D (Marijuana)
  • Conspiracy to violate drug law (Mark Harrington)
  • Unlawful manufacture, cultivation, distribution of (Marijuana)
  • Drug, Possess Class A (#7 Codeine)
  • Drug, Possess Class B (#4 Suboxone)
  • Drug, Possess Class B (#9 Methadone)
  • Drug, Possess Class C (#6 Alprazolam)
  • Drug, Possess Class E (#5 Clonidine)
  • Drug, Possess Class E (#2 Quetiapine)

According to Sheehan, both suspects also had active warrants for distribution of marijuana and conspiracy out of Tewksbury related to this investigation.
