Grand Jury Indicts Zagarella For Manslaughter In Death Of Ethan Costello

LOWELL – District Attorney Marian Ryan has announced that Joseph Zagarella, 19, of Tewksbury, was indicted on October 5, 2017 by a Middlesex County Grand Jury on charges of manslaughter and assault and battery with a dangerous weapon causing serious bodily injury in connection with the 2016 death of 15-year-old Ethan Costello.
A second individual, Thomas Ogden, 51, of Lowell, has also been charged in connection with this incident and indicted with furnishing alcohol to minors for allowing underage teenagers to possess alcoholic beverages at his residence, which is where assault took place.
On Friday, October 28, 2016, the defendant attended a house party at Odgen’s home on Boylston Street in Lowell. A number of teenagers allegedly were drinking at the party, including the victim. The victim allegedly stumbled into Zagarella, who allegedly responded by assaulting the victim, causing his head to hit the concrete floor.
Following the incident the victim was transported to Lowell General Hospital with a traumatic brain injury and later transferred to Tufts Medical Center. The victim was pronounced dead at Tufts Medical Center on Monday, October 31, 2016. Following the Office of the Chief Medical Examiner’s ruling that the manner of death was homicide, Zagarella was charged with manslaughter.
An arraignment date has not been scheduled for either defendant.
These charges are allegations and both defendants are presumed innocent until proven guilty.
