After Nearly Three Years, Suspects To Stand Trial In Death Of Ethan Costello

According to the Office of Middlesex District Attorney Marian Ryan, Joseph Zagarella and Thomas Ogden will stand trial jointly, beginning Aug. 19, in Lowell Superior Court.
Zagarella, now 20, is charged with manslaughter. Ogden, 53, is charged with providing alcohol to minors and for allowing alcohol to be consumed by minors on his property.
Costello, 15, suffered severe injuries at Halloween Party on Oct. 28, 2016, at a residence in Lowell, owned by Ogden. The party, allegedly hosted by Ogden's daughter, was attended by around 70 teens, most from Tewksbury.
According to investigators, many of the teens in attendance were drinking alcohol, including Costello. According to witness accounts, Zagarella arrived at the party late and had not been drinking, when Costello stumbled into him. Allegedly upset, witnesses told investigators Zagarella picked up the smaller Costello and slammed him onto a concrete surface, with Costello landing on his head.
Following the incident the victim was transported to Lowell General Hospital with a traumatic brain injury and later transferred to Tufts Medical Center. The victim was pronounced dead at Tufts Medical Center on Oct. 31.
It took nearly a year of investigative work and testing for the Office of the Medical Examiner to rule the death a homicide. A Grand Jury handed down the indictments shortly afterward.
Since that time, there have been numerous delays and postponements to the legal proceedings. However, according to a spokesperson for the DA's office, the trial will finally begin Aug. 19.
